The EB-3 Green Card is a great option for F-1 /F-2/H-2B/H-1B/H-4/J-1 visa holders in the U.S. and for those residing abroad.

Outside the U.S.

What are the EB-3 Visa Fees?

The total fee for the applicant is $13,500, which includes all immigration attorney fees and USCIS/DOS filing fees for the applicant’s EB-3 Permanent Residence process (excludes I-140 Premium Processing).

The employer pays for all PERM related fees.

We do not charge any recruitment or placement fees related to securing employment.

Installments:

  1. $2,000 – after receiving and accepting your job offer letter from the employer.
  2. $2,500 – after PERM (ETA 9089) is filed (2-8 weeks after 1st).
  3. $3,200 – after PERM is approved (~16 months after 2nd).
  4. $2,500 – before filing your I-140 petition with USCIS (~16-20 months after 2nd).
  5. $3,300 – before DS-260 or Adjustment of Status (~14 months after 4th).

Premium Processing (I-140): optional $2,965.

Medical exam: paid separately at the final stage.

Can my family apply with me?

Yes, when you apply for an EB-3 visa, which is a U.S. employment-based, permanent residency visa, your family members can apply to accompany you. Here’s how it works:

Children: Your unmarried children under the age of 21 can also apply. They would be categorized under E35 (for skilled workers or professionals’ children) or EW5 (for other workers’ children).

Spouse: Your spouse is eligible to apply for a visa under the E34 (if you are a “skilled worker” or “professional”) or EW4 (if you are an “other worker”) category.

If the employer changes their mind or cancels the process?

This is extremely rare. If the employer closes or can no longer offer you a full-time job before you receive your green card, the case may need to be restarted with a new employer. We will do that at no extra cost to you.

It’s important to understand that our employers conduct a recruitment round with us each year. Our employers have had labor shortages and staffing challenges for years, and that is the reason that they are participating in the EB-3 Visa program.

Can you provide an itemized breakdown of the $13,500 fee?

The total fee for your EB-3 Visa / Permanent Residence petition is $13,500, which includes all immigration attorney fees and USCIS filing fees (not related to the PERM petition). eb3.work does not charge any recruitment or placement fees related to securing employment.

This amount is divided into 5 installments to be paid at different stages of the process:

First Installment: $2,000, due after receiving and accepting your job offer letter from the employer.

Second Installment: $2,500, due after your PERM ETA 9089 petition is filed with the Department of Labor (DOL). (Due within 2-8 weeks after the 1st installment).

Third Installment: $3,200, due after your PERM ETA 9089 petition is approved by the DOL. (Due approx. 16 months after the 2nd installment).

Fourth Installment: $2,500, due before filing your I-140 petition with USCIS. (Due approx. 16 – 20 months after the 2nd installment).

Fifth Installment: $3,300, due prior to submitting your DS-260 or Adjustment of Status application. (Due approx. 14 months after the 4th installment).

Is Premium Processing for the I-140 petition included in your fees?

No, premium processing for the I-140 is not included in our fees. Premium processing is optional, so if you wish, you can pay extra for it. Currently, it’s $2,805. It speeds up the I-140 stage, but not the overall EB-3 processing time, because we still have to wait for your priority date to become current before we are able to file your last step, which is either consular processing or adjustment of status.

Are there any hidden fees?

The only fee not included is the medical exam fee, which you pay during the final stage (either Adjustment of Status, or Consular Processing).

Do you offer refunds if my case is denied?

If any stage of your EB-3 process is denied due to an error on our part, we will refile at no extra cost to you. Our sole objective is to get your EB-3 visa approved so you can start work for your employer sponsor.

Do any of the applicant worker fees go toward the PERM petition?

No. None of the applicant worker fees go toward the PERM petition. The applicant fees are for the immigration attorney fees and government filing fees (not related to PERM) and eb3.work service fees.

All of the PERM petition fees are paid for by the employer, in compliance with § 656.12(b).

Do applicant workers pay a recruitment fee?

No. Applicant workers do not pay a recruitment fee. Not all applicants are selected by the eb3.work and/or the employer. The applicant worker fees are for the immigration attorney fees and government filing fees (not related to PERM). All of the PERM petition fees are paid for by the employer, in compliance with § 656.12(b).

Do I need previous work experience or a diploma for EB-3 “Other Workers” jobs?

For most EB-3 “Other Workers” positions, you do not need a university degree or specialized training.

These roles are entry-level and require less than two years of experience to perform, such as fast food crew, housekeeping, caregiving, warehouse, or similar jobs.

You must, however, be healthy enough to do the work and able to meet the employer’s basic requirements for the specific job.

For our entry level EB-3 Visa jobs at eb3.work, there are no formal minimum education or work experience requirements. These are entry-level positions.

We do, however, require basic English proficiency. This means you must be able to communicate in English with us and with your employer sponsor.

What level of English do I need to qualify?

You must have basic conversational English to qualify for our jobs at eb3.work.

You don’t need to be fluent, but you must be able to understand your manager, follow safety instructions, speak with co-workers and customers, and handle daily life in the U.S.

If your English is very limited, we usually recommend improving your language skills before starting the EB-3 process.

Is there an age limit to apply through EB3.Work?

U.S. immigration law does not set a strict upper age limit for EB-3 workers.

However, most employers prefer applicants who are physically able to handle full-time, often physically demanding work and can commit to long-term employment in the U.S.

Which countries do you accept applicants from?

EB3.Work accepts applicants from countries without extreme EB-3 visa backlogs.

Unfortunately we currently do not accept India or China born applicants into our EB-3 visa program due to the long visa bulletin processing times. The employers are unwilling to wait that long. Hopefully the laws will change soon regarding this. 

Because EB-3 Other Workers from India and China often face wait times of 10+ years, most of our articles and checklists focus on applicants from all other countries (often called “Rest of World”).

Can I apply for EB-3 by myself without an employer?

No. You cannot self-petition for an EB-3 green card.

A U.S. employer must first offer you a full-time, permanent job and then sponsor you through the PERM, I-140, and final green card steps.

EB3.Work helps match qualified applicants with employers and coordinates the process with the immigration attorney. We are not a substitute for the employer sponsor.

Will I have to pay U.S. taxes once I start working for my EB-3 employer?

Yes. Once you begin working in the U.S. as a permanent resident, you’ll pay federal and, in many cases, state and local taxes like any other employee. Your employer will withhold taxes from your paycheck.

Can I bring my parents or siblings with me under EB-3?

Unfortunately not. The EB-3 green card only allows you to include your spouse and unmarried children under 21 as dependents.

Parents, brothers, sisters, and other relatives would need to qualify under different U.S. immigration categories.

Can my spouse work in the United States?

Yes. Once your spouse receives their derivative green card, they become a lawful permanent resident and can live and work in the U.S. without needing a separate work visa.

They may apply for jobs and work just like any other permanent resident.

When can I apply for U.S. citizenship after getting my green card?

Most EB-3 green card holders can apply for naturalization after 5 years of continuous permanent residency, assuming they meet all other requirements (such as physical presence, good moral character, and passing the English and civics tests).

Some people choose to renew their green card instead; others apply for citizenship as soon as they’re eligible.
