Step 2
Our employers are ready to meet you and offer you a permanent, full-time position. They will sponsor you for the EB-3 Visa.
Step 3
After you apply for a position, you will receive an agreement.
Please review the agreement carefully.
When you are ready to proceed, please sign and send us the signed agreement.
Step 4
After we receive your agreement and review your application, we will schedule a Zoom interview with you.
During the Zoom interview, we will review the EB-3 Visa process and answer any questions you have.
We will also assess your English conversation skills.
English proficiency is required for most of our positions.
Step 5
After you pass our pre-screening, we will invite you to the Zoom interview with the Employer.
You will be able to meet your EB-3 employer and introduce yourself.
After the Zoom interview with the employer, we will let you know if you have been selected.
Step 6
After we receive your signed offer letter, we will set up your client account at eb3.work.
You will be able to check the status of your case 24/7.
You will be able to complete your information questionnaire and upload your required supporting documents.
You will see the Billing tab and you can pay your first installment at this time.
Step 7
If you have been selected for the position, we will send you an offer letter from the employer to sign and return to us.
If the employer did not select you, that’s ok. We will have other positions you can apply to.
Step 8
PERM Filing:
- We will prepare your PERM Labor Certification petition and email the draft for your review.
- You will review it and confirm that your name and address are correct.
- We will file the PERM petition with the DOL (Department of Labor).
- You will receive a PERM DOL case # that you can use to track the status of the PERM case on the DOL website.
- The PERM process is currently taking 15+ months.
- Your Priority Date is the date that your PERM is filed with the DOL.
- The 2nd installment is due at this stage. We will update your account with the 2nd installment invoice.
Step 9
- PERM Approval:
- Once your PERM is approved, we will prepare and file your I-140 petition with USCIS.
- We will email you the draft so you can review it and confirm that your name and address are spelled correctly.
- The 3rd and 4th installments are due at this stage. We will update your account with the invoice.
- I-140 Filing:
- After we file the I-140 with USCIS, we will receive a USCIS case number on the I-797 filing receipt.
- You can use that case number to track the status of your I-140 petition with USCIS.
- USCIS I-140 processing time is currently around 12 months.
- There is an option for Premium Processing for the I-140, but it is not necessary during retrogression.
- I-140 Approval:
- If you are doing Consular Processing, then we will set up your 5th and final installment invoice at this time.
- If you are doing Adjustment of Status, we will wait for your priority date to become current, then we will set up your 5th and final installment invoice
Step 10
- AOS stand for Adjustment of Status.
- Adjustment of Status is used if you are in the U.S. and have legal status on a temporary visa (such as F-1, F-2, H-4, H-2B).
- Once your priority date is current (according to the visa bulletin), we will prepare and file your AOS petition with USCIS.
- If you have dependents, they will apply for AOS at the same time.
- You can apply for a temporary work permit with the AOS filing.
- CP stands for Consular Processing.
- Consular Processing is used if you are outside the U.S. when your priority date is current.
- The first step is filing the DS-260 with the NVC (National Visa Center).
- The DS-260 filing usually happens shortly after the I-140 is approved.
- Once your priority date is current, we will receive your Consular Interview Appointment Date.
- You will do the required Medical Exam at this time.
Step 11
- If you applied for Adjustment of Status:
- Once your Adjustment of Status is approved, you will be a Permanent Resident of the United States.
- If you applied for Consular Processing:
- After your successful consular interview, your passport will be stamped with the EB-3 Visa. This means that you are now a Permanent Resident of the United States.
- The EB-3 Visa will give you a 6-month window to travel to the U.S.
Step 12
- Now that your EB-3 Visa has been approved and you are a Permanent Resident of the United States, you can start working for your EB-3 Employer.
- Our team will assist you with finding housing, setting up your bank account, getting your social security card, and acclimating to the community.
